Under Chapter 173-167 WAC, the Department of Ecology (Ecology) has adopted an Emergency Drought Funding Rule to continue the Drought Response Grant for eligible public entities within the Yakima Basin Watersheds. The rule designates eligibility criteria for applicants and projects applying for grant funds aimed to alleviate hardships resulting from the currently declared drought in the Yakima Basin watersheds. These watersheds include Yakima watersheds of Upper Yakima, Lower Yakima, and Naches, which encompasses parts of Yakima, Kittitas, and Benton counties. Further, Ecology may consider adopting further emergency rules and is in process on developing a permanent drought relief rule through rulemaking. The Drought Response Grant is available until August 7, 2025 for eligible public entities.

Drought conditions have not changed as of the reissuance of this rule. On April 8, 2025, the Director of Ecology, under the authority of RCW 70A.02.120(2), has determined that in the event this emergency rule is considered a significant agency action under the Healthy Environment for All (HEAL) Act, this rule is exempt from the requirements of RCW 70A.02.060. This exemption includes the need to complete an environmental justice assessment. Delay in adopting this rule is likely to pose serious harm to the public’s interests. Through procedures described in the Administrative Procedure Act, chapter 34.05 RCW and RCW 34.05.330, the rule adoption can be appealed.
