L&I updates draft policy to provide guidance on job posting requirements

L&I’s Employment Standards Program has made changes to its draft administrative policy that will give employers guidance on new job posting requirements. The changes are based on recent public feedback received. The program is now seeking public comment on the second draft of the policy.

Engrossed Substitute Senate Bill 5761, which goes into effect Jan. 1, 2023, amends part of the Equal Pay and Opportunities Act (RCW 49.58). The Washington State Department of Labor & Industries enforces the act.

Under the new law, employers will have to include information in job postings such as a wage/salary range, and a general description of all benefits and other compensation. These requirements apply only to employers with 15 or more employees. The program rewrote portions of the draft policy to provide additional clarity around these requirements.

The policy, ES.E.1 Equal Pay and Opportunities Act, also provides guidance on the department’s existing interpretations of the act.
